Why are we remained Silent against Hate Crimes?.
Selma Goncalves, 20, was killed January 21, 2009 by an attacker in her Brockton apartment. Another woman was shot and is recovering and a third person, a 72 year old man Arlindo Goncvalves, no relation, was shot and killed by the attacker as he fled the woman's home. The attacker, Keith Luke age 22 of Brockton had set out on a mission of hate killings according to the police. He wanted to kill and many non-whites and jews as possible. According to Luke, his intended target after the murder of Goncalves was a synagogue in Brockton that was hosting a weekly Bingo game that draws hundreds. Luke was captured after a wild chase and shootout over three miles in the city of 90,000. Selma Gonsalves had come to Brockton a year ago from her native Cape Verde. Luke face multiple charges of murder and other charges.

There was all the symbolism necessary for the glory he seeks: hundreds of men dressed in prison stripes with pink underwear protruding from their waists,
surrounded by even more heavily armed guards and at a given moment an old man gave a signal and they were marched through a public street into a tent jail that would house only other men of their color and status surrounded by a high electrified fence... and the old man pontificated about the law...Chihuahua hasta cuando esto va a parar, This a reminder to all Latinos, Hispanics and those looks kinda a Mexican.
We need to stop the continues violation of our civil rights, we have been diminished day by day, they are killing us by their hatred emotions day by day, They are demonizing everyone just because we look kinda a Mexican....I ask myself what's wrong with being or look like Mexican? or that Racism?. Do you believe you have been attained or acquired equally rights as Hispanic or Latino?. Nooooooo. do you ever heard this comment from Real State Agents: Do not buy a house on this neighborhood; you will better off on Latino or Hispanic community. How many times do you hear this comments at Dealerships, You are not qualified for this loan because your credit is bad?; But someone else with the same credit or even worst get better rate and loan performance. We always have been used and abused, stereotyping, discriminated, demonized and racially segregated. We need to stop and send a clear message. Enough is enough. We are entitled to a same and equal rights like everybody else.
While on Immigration there are valid arguments on both sides of the issue, the debate has also been framed, at times, by vitriolic anti-immigrant – and particularly anti-Hispanic – rhetoric and propaganda. Purveyors of this extremist rhetoric use stereotypes and outright bigotry to target immigrants kinda look like Mexican and hold them responsible for numerous societal ills. Why?. see some of the vitriols arguments from Anti Immigrants groups:
1.-Describing immigrants as "third world invaders," who come to America to destroy our heritage, "colonize" the country and attack our "way of life." This charge is used against Hispanics, Asians and other people of color.
2.-Using terminology that describes immigrants as part of "hordes" that "swarm" over the border. This dehumanizing language has become common.
3.-Portraying immigrants as carriers of diseases like leprosy, tuberculosis, Chagas disease (a potentially fatal parasitic disease), dengue fever, polio, malaria.
4.-Depicting immigrants as criminals, murderers, rapists, terrorists, and a danger to children and families.
5.-Propagating conspiracy theories about an alleged secret "reconquista" plot by Mexican immigrants to create a "greater Mexico" by seizing seven states in the American Southwest that once belonged to Mexico.

Stimulus bill for Liars like Lou Dobbs and Bill O’Reilly.

From what I've been able to find on reputable sites, (New York Times, Factcheck.org) and from my own knowledge Undocumented Immigrants pay more than 7 billion dollars into the system each year in Social Security payroll deductions and 1.5 billion dollars in Medicare taxes.
Most of the people use fake social Security cards or ITIN (Individual Taxpayer Identification Number) to get jobs and most don't collect. Both Social Security and medicare would be in even worse shape if the undocumented workers were able to collect benefits but they are not entitled to any benefits.
Even if some are getting benefits, the overwhelming majority pay into the systems but never get anything from the system.
I'm not making excuses; I am just trying not to be blinded by the message of hatred from those who really are reacting without thinking their positions through.
Pushing false information has lasting consequences on the image of immigrants, and those perceived to be foreign.
On January 29, 2009, Associated Press staff writer Julie Hirschfeld Davis, released the article “Hill Republican: Stimulus aids illegal immigrants” where the false assertion was made that the Stimulus package would provide money for undocumented immigrants:
The $800 billion-plus economic stimulus measure making its way through Congress could steer government checks to illegal immigrants, a top Republican congressional official asserted Thursday.
Shortly after its publication, the story gained a lot of public attention by the conservative news site The Drudge Report, CNN’s Lou Dobbs, and FOX News. Hours after the false claim was retracted by the AP (3:02 p.m. ET), these “news organizations” repeated it nonetheless. The Drudge Report kept the link to the uncorrected AP story up for 4 hours. Dobbs made the claim at 5:27 pm ET. FOX News repeated the claim at 6:09 pm ET, and then again at 8:16 pm ET on Bill O’Reilly’s.
As it turned out, the one single anonymous source was later withdrawn and the article was rewritten to show the information provided by that source had been false.
A senior GOP congressional official expressed concern Thursday that the bill could steer government checks to undocumented workers, but in fact the measure prevents anyone without a Social Security number from claiming tax credits of $500 per worker and $1,000 per couple.
Stories like these tend to instigate anti-immigration sentiments given the controversial topic, and Fox News, Lou Dobbs, and the Drudge Report only add fuel to the fire. The point is simple: pushing false information has the lasting consequences on the image of immigrants, and those perceived to be foreign. Ineffectively informing the public about two important issues, immigration and the economy, will only strengthen the tensions amongst the various ideologies debating these topics.

Why we remained silent towards Racism and Hate against Minorities?

I do understand that people living in fear due to the Economic Crisis, but that is not an excuse, or reason to response and utilize hate or racism as a vehicle as escape of they own emotional actions against Minorities. Every time ICE reinforce Raids and safety, We develop a big wave of fear but we do not understand that the most destructive element in the human mind is fear and FEAR creates aggressiveness.
STOP HATE, STOP RACISM, ENDS INTOLERANCE, AND STOP BIGOTRY.

A spate of seemingly unrelated incidents in Mountain View — a vandalized school sign; middle school students chased down a street by BB gun wielding teens; a neighbor unhappy about Latino day laborers; and more recently, an e-mail peppered with racial insults directed at the new mayor — has rattled officials and leaders of a city that views itself as a model of diversity.
Days before she was sworn in to office, Mayor Margaret Abe-Koga, the city's first Asian-American female mayor, received e-mail through her public City Hall address. "I can't believe this city elected a stupid Asian-American like you," Abe-Koga quoted from the unsigned e-mail, which went on to blame undocumented immigrants for the country's economic woes.
"It didn't surprise me," said the Harvard University graduate Abe-Koga. "But I was angry."
The day she took office Jan. 6, Abe-Koga, 38, condemned the recent incidents that occurred weeks apart late last year, and referred to the e-mail she received.
"To remain silent was something I couldn't do," Abe-Koga said. "This is not what we're about. We need to come together."
Abe-Koga has joined a growing chorus of city leaders and community groups who say the incidents may be isolated, but a forceful, vocal response is the best defense against a worrisome trend that "something is brewing" in Mountain View.
"It's happening to middle school students. It's happening to the mayor," said Oscar
Garcia, president and co-founder of Mesa de la Comunidad, a local education and advocacy group for Latinos. "The community needs to know it's happening at all levels."
Garcia is teaming up with Alicia Crank, a former city human relations commissioner, the police department and other community leaders to plan a "Not In Our Town" gathering, an event named after a 1995 film documentary about the unequivocal response by residents of Billings, Mont., against white supremacists. A similar gathering was held in Newark in 2003, a year after the killing of a transgender teenager.
"We need to ask where this is coming from," Crank said. "There's something there that needs to be exposed so we can move past it." The event has not been scheduled.
The first incident was reported the day after the November election. Garcia's wife was driving past an empty lot festooned with all sorts of candidate campaign signs. One sign stood out. "No More Aliens" was stenciled in red across a Spanish sign about school registration.
"To me it was a deliberate attempt to intimidate the Latino community," Garcia said. "To me, the message was, 'Anyone who speaks Spanish, you're not welcome here.' "
Also sometime in November, day laborers at the Mountain View Day Worker Center's old office on Escuela Avenue were confronted and reportedly intimidated by an apparently disgruntled neighbor unhappy about the immigrant workers.
"There's a lot fear," said Maria Marroquin, executive director the day worker center, which is now located near downtown Mountain View. "There's a lot of ignorance."
On Dec. 5, three white teens, ages 14 and 15, were arrested by police and charged with hate crimes, making criminal threats, brandishing a replica firearm and conspiracy to commit a felony. One of the 15-year-olds was also charged with possession of marijuana. The cases are pending in juvenile court and the identities of the teens were not released by police.
According to police, four 11-year-old Latino students were walking home from school. As they walked, the teens shouted racial comments from the open window of a house and threatened to kill the students. Then the teens chased the students down the street.
In an interview with the Mercury News, Abe-Koga, the daughter of Japanese immigrants, disclosed another incident in December. As she and her 7-year-old daughter were walking from Castro Elementary School, a group of Latino boys began talking. She said she realized later that the boys were doing a racial taunt, speaking mock Chinese.
"I just felt sadness," she said. "Maybe there's no connection between these incidents, but I want people to be aware of this problem."

English Only in Nashville, TN, A waste of taxpayer money or Anti Immigrant measurement?

No person shall have a right to government services in any other language. All meetings of the Metro Council, Boards, and Commissions of the Metropolitan Government shall be conducted in English. The Metro Council may make specific exceptions to protect public health and safety. Nothing in this measure shall be interpreted to conflict with federal or state lawIn the same week President Barack Obama championed the country for being shaped by every language and culture, Nashville voters today will head to the polls to decide whether their Metro government will conduct its business in only one language — English.
This is the current Tennessee Acts of 1984, ch. 821, § 1.]":
English is hereby established as the official and legal language of Tennessee. All communications and publications, including ballots, produced by governmental entities in Tennessee shall be in English, and instruction in the public schools and colleges of Tennessee shall be conducted in English unless the nature of the course would require otherwise.
Seems to me that Mr. Eric Crafton has some problem on understanding the Law because he breaks the law by not reporting donors as required by LAW. What's Mr. Crafton try to accomplish? embarrasement? waste of taxpayers money? Political power? or being recognized as Anti Immigrant? but he is not facing the real problems of his own Budget deficit were the Emergency response are under staffing. The English Only special election brings to a head an issue that’s been hovering over Music City since 2007 when Metro Council passed an ordinance which was ultimately vetoed by former Mayor Bill Purcell.
English Only proposes to make English the official language of Metro, while also stating individuals have no right to services in other languages. It offers the provision that Metro Council may make exceptions for health and safety purposes, but Title VI of the federal Civil Rights Act already mandates most local government offices must offer their services to all citizens.
Metro’s major departments have repeatedly said they have virtually no idea the impact the charter amendment proposal would have, if it were to pass.
The primary champion of English Only has been Eric Crafton, a Metro Council member from Bellevue, who insists the proposal is merely to ensure Metro’s board, commission and Council meetings are done in one language. Crafton says Tennessee code annotated, which already makes English the state’s official language, doesn’t go far enough.
And yesterday, on the eve of the special election, he was confident of a victory.
“Nashville English First (the local committee advocating the proposal) has won a tremendous victory just by giving people the chance to vote,” Crafton said. “They had to go through two lawsuits and two petition drives just to give the people the chance to vote, despite efforts by the anti-English crowd to suppress. I think that is what democracy is all about. I’m very proud and very excited. I hope 50,000 people turn out to vote.”
Crafton has consistently said that English Only is simply about whether Metro business should be conducted in one language. But only last month The City Paper interviewed some of the Davidson County residents who signed his petition drive and streamlining Metro business was not the reason they supported the charter amendment proposal — instead their comments touched on the issue of illegal immigration.
It is the anti-immigrant sentiment that has rallied a broad coalition against Crafton’s English Only push, which starts at the top with Mayor Karl Dean, who has spoken out against English Only since Crafton began the petition drive last summer.
In recent weeks, Dean has ramped up his opposition by filming television advertisements, recording a message for automated “robo” calls to voters and conducting a series of national interviews on the issue.
Joining Dean in opposing the charter amendment proposal are the Nashville Area Chamber of Commerce, the Convention and Visitors Bureau, a coalition of dozens of area churches and faith-based groups, immigrant rights groups and even some prominent Nashville Republicans.
“I really can’t speculate on the outcome,” Dean said when asked how he thinks today’s election will go. “I am proud of the unprecedented coalition of business groups, activist groups, individuals, church leaders, university presidents — all the people who have come together to make a statement about who we are as a city, regardless of the outcome.
“I do know this. No matter what comes of the election, Nashville will still be a great city, and we will continue to move ahead and stay focused on the things we want to accomplish,” Dean said.
The list of media outlets following the special election continues to grow. The New York Times, Fox News, and Lou Dobbs from CNN, have all covered the special election in recent weeks. A City Paper reporter was interviewed by the BBC yesterday on the issue.
Crafton blames the opposition for drawing so much attention nationally to the issue. He insisted that if Purcell had not vetoed his original Council bill, then no one outside of Nashville would have noticed. As it stands, Nashville is on the verge of becoming the largest municipality to pass an English Only resolution.
“The whole thing has been blown out of proportion and unfortunately the anti-English folks have made this into a national issue,” Crafton said. “The very thing they wanted to avoid, they caused, but by their actions they’ve made this a national issue.”
Opponents say the proposal sends the wrong message about Nashville, a city they point out is growing more diverse with each passing year.
Stephen Fotopulos, executive director of the Tennessee Immigrant and Refugee Rights Coalition said the community his nonprofit advocacy organization represents is keeping a close watch on today’s election results.
“I personally have never seen the immigrant and refugee community in Middle Tennessee so unified around a certain issue,” Fotopulos said. “I think English Only more than anything else makes it clear that this is not an assault on one group. It’s an assault against everyone who looks or sounds different.
“I’m incredibly encouraged to see leaders of the immigrant and refugee community come together.”
In the English Only fund-raising race, Crafton told The City Paper his group had raised about $60,000, a far cry from the nearly $300,000 the opposition raised. However, Crafton and Nashville English First refused to file a financial disclosure with the Davidson County Election Commission until after today’s election.
“For people not to want people to become self-sufficient, to me is the wrong approach,” Crafton said. “I am surprised, to some extent, at how much money they raised to oppose something that a vast majority of people support.”
The English Only proposal is not the only one on today’s ballot. There is also a proposal to simplify the petition-driven charter amendment process.
That proposal would allow for referendum proposals to coincide with every countywide election and would downsize the number of signatures needed to put a proposal on a ballot.
Dean and others have spoken out against the second proposal, too, stating it would make it too easy to amend Metro’s governing document. Metro government has already been shaped distinctly by one referendum that now forces all future property tax increases to go to a referendum for approval.

The Crossroads of the failed Immigration Policies.

For an uninsured immigrant suffering a traumatic injury or serious illness, a trip to the wrong emergency room can lead to deportation, even if the immigrant is in the country legally, The New York Times reports. A hospital in Phoenix sent 19-year-old Antonio Torres on a four-hour trip back to Mexico after he showed up in the emergency room with catastrophic injuries from a car accident, despite the fierce protests of his parents.
He and his family were in the country legally, working in the alfalfa fields in Gila Bend, Ariz. While a deadly infection spread through his body as he stayed in a Mexican hospital, his parents found a hospital in California willing to treat him and got him back into the country in a donated ambulance. He recovered despite the dismal prognosis given to him by the hospital in Phoenix.
There are no formal regulations or guidelines for hospitals in the handling of patients like Torres, and they have access to limited federal financing to pay for their treatment, according to the Times, which examined similar cases across the country. Therefore, treatment can vary widely among hospitals left to make the decision whether to treat an uninsured immigrant and bear the costs or repatriate the patient, potentially risking the individual's life in the process.
As a result of the reporting done by the Times, the California Medical Association passed a resolution opposing enforced repatriation of patients. A similar resolution is being considered by the American Medical Association.

Lies versus facts about Immigration

If the adverse effects or conditions of immigration were so severe, why do people find it necessary to create and spread lies about it? Something to think about.
The scapegoating of immigrants for various social ills and the perpetuation of a false narrative of “a border under siege” have been fueled in recent decades by the cold war, economic woes and 9/11. The events of 9/11 placed unlawful entry into the United States in the context of national security. Since then many people have all but conflated border crossings in the southwestern United States with the security breaches of large-scale, violent consequence. Even though not one terrorist has been caught along the southwestern border, campaign rhetoric in this election season has identified “toughness” on crime or on terror with punitive immigration policies. Faithful citizens must remain vigilant about the pervasive attitudes that influence us at least as much as Gospel values do, attitudes conveyed in the media and in political rhetoric that encourage xenophobia or ethno-cultural nationalism.
The lives of undocumented immigrants tell a more complex story than that of willful lawbreaking. This is particularly true when we consider the inadequacy of current law, the failure of approaches that begin and end with enforcement, and the commitment to natural law, which censures human structures that enable exploitation and dehumanization. The Human rights groups position defends marginalized persons regardless of their legal status, particularly those who survive harrowing border crossings and experience exploitation in our legal system and labor market. Rooted in a concept of justice that is relational, effusive and marked by mercy, teaching demands that we refuse to pit the rights of U.S. workers against those of international workers. A commitment to human dignity and solidarity calls us to guard against narrow nationalism, the idolatry of the market and the demonization of the other. From repentance we are called to social conversion toward interdependence in solidarity.
Look Who’s Talking About Latinos
It should come as no surprise that coverage of immigration, especially on talk radio, is often hard to categorize as anything but hateful. Rush Limbaugh and Michael Savage are among the major culprits who routinely demonize Latino immigrants on their programs.
On cable TV, CNN host Lou Dobbs has used his show to crusade against undocumented immigration. More than 70 percent of his programs in 2007 discussed the issue, according to the watchdog group Media Matters.
But Dobbs has had plenty of help from his cable compadres. Bill O’Reilly and Glenn Beck have discussed undocumented immigration on 56 percent and 28 percent of their programs, respectively, almost always with an anti-immigrant slant.
The news networks have reinforced the idea there is little to know about Latinos outside of immigration. For years, the National Association of Hispanic Journalists has documented in its annual “Network Brownout” that Latinos make up less than 1 percent of the more than 12,000 news stories that air each year on the network evening news. Undocumented immigration and crime were the dominate focus of those stories.
The rise of anti-immigrant sentiment has impacted the Latino community immensely. A Pew Hispanic study released this week found that 1 in 10 Latinos have been stopped by the police or authorities and asked about their immigration status. Half of Latinos surveyed said the situation for Latinos has gotten worse over the past year due to concerns about deportation and discrimination in other areas of their lives, like finding jobs and housing.

The report states that each year, state governments spend an estimated $11 billion to $22billion to provide welfare to immigrants. A reference is made to footnote 2. Footnote 2 refers to a report by Center for Immigration Studies CIS “Back Where We Started: An Examination of Trends in Immigrant Welfare Use Since Welfare Reform”. The CIS report contains no documentation to support the claim that FAIR made. A chart in the CIS report finds that 24.3% of Undocumented immigrant households used some welfare program. The average payment was $1,040. The report says there were about 8 million Undocumented immigrants in the country in 2002. Estimate 3 persons per household. The result is less than $1 billion. The FAIR report does not state how they arrived at the $11 billion to $22 billion figure from the CIS report either do not support any documentation about how they identify the numbers of Legal and Undocumented Immigrants. Again estimation versus facts. Meaning lies, lies, lies.

The link refers to the April 1, 2006 transcript of Lou Dobbs Tonight. In the transcript, reporter Christine Romans states that The Federation for American Immigration Reform says taxpayers spend $12 billion a year on primary and secondary school education for children here illegally.A report by FAIR from 2005 entitled “Breaking the Piggy Bank: How Illegal Immigration is Sending Schools Into the Red” provides the basis for these claims. What the FAIR report blatantly fails to include are the taxes paid by the immigrants and the return on the investment of education.A family with two children in school pays property taxes of $3,000 per year. The cost to the school district is $16,000 resulting in a net cost to taxpayers of $13,000 per year. However, before and after the children are in school, the family pays real estate taxes. In addition, after the children graduate, their education will result in increased earnings potential. Some studies have found that merely graduating high school increases a student’s lifetime earnings potential by as much as 40%. The result is a net benefit to society as a whole. and Again FAIR report does not state how they arrived to that figure. Immigration system needs a comprehensive reform.

How many times do you hear do it legally, be on line, do it thru the right way. Well, a perfect example how the Immigration system needs a constructive reform.
After a two-year long distance relationship, Nancy and her fiance were finally reunited in the U.S. Immediately upon entering the U.S., her fiance filed for adjustment of status and his green card application was filed in September, 2002. They did everything by the book, followed all the immigration laws. Trouble was, the government didn't.
We met when I was working in Germany - he is Romanian," says Nancy Harris (not her real name pending a lawsuit). "I came back to the U.S. in 2000 and my fiance was finishing his PhD, so he couldn't arrive until 2002. We were married at a courthouse in downtown Manhattan. Right away, he applied for a work permit but it was delayed beyond the point that was legally allowable. There were no explanations given, we were just given the 'run-around.'
So many things went wrong with the Immigration and Naturalization Service (INS) that I could go on for hours. There was absolutely no reason for any delays. My husband had to start a job in January at Mt. Sinai hospital but without the work permit all he could do was volunteer without pay. Finally, he was so frustrated that he went to the INS office and told them he wouldn't leave until he was granted a work permit. They just called the police. My husband must have filled out 50 inquiry forms.
The three-month time limit to be granted a permit always expired. The details of these permits, the endless paperwork, goes on for hours, years... And the INS are never helpful; they don't even live by their own rules. Not once was there an answer to our inquiries. In the past five years, I contacted Hillary Clinton, a few members of Congress, the offices of George Bush and Dick Cheney. I think that the only reason he got any help was because Cheney's office finally looked at the applications. My husband is a scientist and works in biotechnology - I think the U.S. can benefit from his expertise and this is the treatment he received.
He applied numerous times for advanced payroll - permission to leave the country. He got a work permit but without a green card, we have no idea how many jobs he was turned down.
I can't even start to calculate the expense. We even paid for some forms twice, such as advance payroll and work permit applications. And for his initial application for adjustment of status, we weren't even given a receipt of any information that the INS had received our check. This would have been in 2002. Finally, we found out from Western Union (the only company that issues a cashier's check) that it had been cashed. I now have a form that says our money was received in 2002 and the form was sent to us in 2005! They took our money and gave us nothing in return.
My husband is now working at NYU, most likely at a lower position than if he had been issued a green card years ago. Biotechnology companies are always looking for scientists, it is a very desirable position. But he couldn't apply for grant money - which is a major funding source for scientists - and we have been economically challenged because of all this, maybe not as bad as some people, but frustrating nonetheless.
We did everything the right way - the exact government protocol. As far as I can tell, they punish people like us who do things by the book. I don't blame people who work here illegally. At the end of the day, what is the INS accomplishing? The magnitude of how disorganized they are is unbelievable - if they could misplace and lose all our forms, how can they screen terrorists, how can they protect us? Instead, they are harassing law-abiding people and I certainly don't have any confidence in their screening process. And our tax money pays for this fiasco.
I hope something comes of this, a change to these archaic immigration laws - if for no reason other than more people won't have to go through the INS mess.

ICE Preventing Terror from abroad but creating Raids and Terror without Reform

The House Judiciary Committee's Subcommittee on Immigration, Citizenship, Refugees, Border Security, and International Law held a “Hearing on Problems with ICE Interrogation, Detention, and Removal Procedures.” The hearing featured American citizens caught in Immigration and Customs Enforcement (ICE) raids, detention, and deportation.
Witnesses included Marie Justeen Mancha, a U.S. citizen high school student from Georgia who was home alone when armed ICE agents broke into her house one afternoon; Michael Graves who, as a U.S. citizen employee of the Swift Co. meatpacking plant in Marshalltown, Iowa, was one of hundreds of workers detained for hours while riot-gear-wearing ICE agents interrogated them on their citizenship status; Kara Hartzler, an attorney with the Florence Immigrant & Refugee Rights Project in Arizona; and others.
In his testimony, Mr. Graves painted a frightening picture of an agency that, all across the country, has been sending heavily-armed agents after people whose “crime” is working without permission:
hundreds of heavily armed ICE agents stormed six meat packing plants across America’s heartland. …regardless of my status, [ICE]’s interrogation, the handcuffs, the guns, and the agents in SWAT uniforms were all incredibly unnecessary and intimidating …I am a U.S. citizen. I was born and raised in this country – in the same state I work and have never been overseas in my life …No one in this country, regardless of their status, should be treated the way we were treated at the Marshalltown Swift plant or any of the Swift plants. Working is not a crime, and workers do not leave their constitutional rights at the plant gate.
At the hearing, Rep. Zoe Lofgren, a California Democrat and chair of the subcommittee remarked that the United States had reached an era “where an overzealous government is interrogating, detaining and deporting its own citizens while treating non-citizens even worse,” according to a Cox News Service story carried in the Austin American Statesman.
The specter of government agents, guns drawn, going after workers on the shop floor, or breaking into homes without a warrant, is not only terrifying, but can only breed more distrust of the government in communities across America. Yet, this sort of behavior is just one symptom of enforcement-without-reform and a deportation-only approach to immigration. There is a desperate need for broader oversight and for sensible immigration reform policies.
Marie Justeen Mancha, an American citizen and high school student from Reidsville, Ga., told lawmakers Wednesday that she was terrified when four federal agents stormed into her house, screaming, "Police! Illegals!"
A House panel was examining similar incidents in which U.S. citizens were questioned, detained or deported in raids over the past year.
"My heart just dropped," Mancha said. "When the tall man reached for his gun, I just stood there feeling so scared. I could've busted out in tears, but I had to be strong and hold it in."
Mancha, who was 15 years old at the time and alone in her home, testified before the House Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law, about the incident, which occurred in conjunction with a September 2006 Immigration and Customs Enforcement (ICE) raid at a poultry plant in nearby Stillmore, Ga.
"I carry that fear with me every day, wondering when they'll come back," she said, in a heavy Southern accent.
Gary Mead, assistant director for detention and removal at ICE, told the panel that his agency has "never knowingly or intentionally detained or removed a U.S. citizen."
In the "highly unlikely" event that an ICE officer determines that a U.S. citizen has been mistakenly deported, ICE takes appropriate action to locate the citizen and ensure immediate repatriation to the United States at no expense to the person, he said.
In the past four years, ICE has detained more than 1 million people and deported only one U.S. citizen, he said. That person — Peter Guzman — told ICE agents that he was a Mexican citizen, Mead said.
Guzman's attorney, James Brosnahan, also testified before the committee. He described his client as "a person of limited mental capacity" and unable to read at more than a second grade level.
"They put him on a bus with $3 ././. and he was a U.S. citizen," Brosnahan said.
After being deported to Mexico, Guzman wandered on foot over hundreds of miles for 89 days between Tijuana and Calexico and survived by begging and picking food from garbage, Brosnahan said.
Guzman's mother went to the morgues of Tijuana to see if she could find her son, he added.
Brosnahan said Guzman's detention was not an innocent mistake but the consequence of "policies, practices and procedures which rely upon racial and ethnic stereotypes to presuppose undocumented status."
Democrats on the committee grilled Mead about several cases. They said they were angry that he did not know certain facts, such as what percentage of people arrested by ICE in the past year were Hispanic. He could only say that those arrested were "predominantly Hispanic."
Rep. Luis Gutierrez, D-Ill., said he was upset that Mead was unaware of an incident in Chicago where, according to Gutierrez, about 100 Hispanic men of a certain age were detained by ICE agents in a mall. The agents were searching for four men who were allegedly engaged in an identity theft ring, he said.
Mead said that the agency does not detain people based on nationality.
"We deport people based on their legal status and their right to be here, not their color," he said. "We do not racially profile."
Mead said that ICE is reviewing its policies and procedures to determine if even greater safeguards can be put in place to prevent the rare instances when U.S. citizens are mistakenly arrested or deported. The review is expected to be completed within the next 60 days.
Rep. Steven King, R-Iowa, ranking member of the committee, objected to the hearing topic, saying that a few isolated instances have been exaggerated and that a problem does not exist with ICE detaining U.S. citizens.
He said ICE needs to focus on deporting the "12 to 20 million" illegal immigrants in the United States that should be removed, but are not. The Department of Homeland Security estimates there are 12 million illegal immigrants in the United States.
Mead said he could not comment on Mancha's case, because it is part of current litigation.
Mancha is one of the plaintiffs in a lawsuit against ICE that alleges that federal agents illegally detained, searched and harassed Latinos solely because of their appearance, in violation of their Fourth and Fifth Amendment rights.
The lawsuit was filed by the Southern Poverty Law Center, a civil rights organization based in Montgomery, Ala. It alleges that the agents did not limit the raid to the poultry plant in Stillmore, but fanned out across residential areas, stopping motorists, breaking into people's homes, and threatening people with tear gas and guns.

A North Carolina sheriff has apologized for calling illegal immigrants "trashy" and saying the growing Hispanic population in his county was "breeding like rabbits".
Johnston County Sheriff Steve Bizzell issued the apology after the News & Observer of Raleigh printed comments in a Sunday article, the newspaper said Monday. Bizzell also told the newspaper, "Everywhere you look it's like little Mexico around here."Bizzell said in a one-paragraph statement that it wasn't his intention to make broad statements that reflected on legal and law-abiding Hispanics.
But the apology wasn't enough for a Hispanic advocate. Tony Asion is executive director of the nonprofit advocacy group El Pueblo and said the comments made him so angry he had to stop reading the article.
"I don't want his apology, I want his badge," said Asion, a native of Cuba. "As a 20-year veteran of the Delaware State Police force, I resent the fact that he's even a cop."
Bizzell said his comments, made during interviews for a series of stories, were influenced by his anger over the death of a boy in April who was killed by a drunken driver who previously had been convicted of driving while impaired.
"I obviously let my anger over this crime flash during the N&O interview," Bizzell said. "Since then I have worked with federal authorities to deport illegal immigrants that commit crimes because these criminals ultimately have a negative impact on all the good law-abiding residents in Johnston County."
"This is not a reflection on all immigrants as legal immigration is both wanted and needed."
Bizzell is a former president of the N.C. Sheriffs' Association and worked to make North Carolina an aggressive state for deporting illegal immigrants.

This group is like most others leading the anti-immigration movement. They like to say “Hey, we’re all for legal immigration, it’s just the illegal kind we oppose.” Boloney! The press and the people who are truly concerned about reducing illegal immigration should wake up and call them on this.
The only way we are going to seriously reduce the population of undocumented immigrants is by creating legal channels that immigrants will choose to go through rather than around, reduce visa backlogs that stretch in some cases to more than two decades, and create a mechanism by which law abiding immigrants can get in the system if they are here illegally, thereby weeding out people who are truly not welcome, like criminals.
The way we get control is to regulate reality, not by keeping legal immigration levels unrealistically low and clogged and hoping 12 million people will be forced out or otherwise disappear.
Of course, that type of argument, which is persuasive to the vast majority of Americans, is not going to move the ALIPAC’s, FAIR’s, Tancredo’s, or Dobbs’ of this country. They find the lack of viable legal immigration channels a bonus to their side because it allows them to rail against the illegalities. But in fact, illegal immigration is merely a target of opportunity in their fight to reduce or illuminate legal immigration.
You will see the telltale signs of ALIPAC mobilization on the comment boards of your local newspaper. Aside from fundraising, the ALIPAC website is a rapid response operation to drive anti-immigration advocates to stories where they can post their comments. Here is a ripe example of the thinking of these advocates, responding to a story about a U.S. Olympic gold medalist whose mother was allegedly undocumented:
He’s winning in the Olympics while tens of thousands more illegals are robbing, killing and raping as members of gangs across the country. I will gladly take an Olympic loss and save an American’s life any day. F the liberal media and what they are doing to destroy our country
Wow! Hating an American citizen who has won a gold medal for your country seems a little harsh, but that’s what these cats are about.
The next time you see them lurking, please challenge them about A) whether they really support legal immigration, B) whether they truly believe that we are going to force 12 million people out of our country, including the 7 plus million in the workforce (1 in 20 workers in the U.S. economy) while preventing anymore from settling here because we are building a big wall, and C) what kind of hallucinogenic drugs they are smoking, shooting, snorting or otherwise ingesting?
Will we’re at it, why doesn’t the Federation for American Immigration reform change its name to the Federation Against Immigration Reform, since, like ALIPAC, they are one of the main opponents of moving past our gridlocked politics and fixing America’s immigration system?

Immigrants causing a climate change?.

Just when you thought that immigrants couldn’t be blamed for any more of America’s troubles, the Center for Immigration Studies introduces yet another item to the grievance list: Immigrants are the driving force behind climate change.
Once again, the Center for Immigration Studies has found a way to fudge the numbers and use a critical issue to support their anti-immigrant agenda, as shown in their new “research study” titled “Immigration to the United States and World-Wide Greenhouse Gas Emissions”. The study dubiously claims that:
“future levels of immigration will have a significant impact on efforts toreduce global CO2 emissions. Immigration to the United States significantly increases world-wide CO2 emissions because it transfers population from lower-polluting parts of the world to the United States, which is a higher polluting country.”
Their argument is that if immigrants had stayed in their home countries, they wouldn’t have produced such large quantities of greenhouse gases, because
“By and large, people who migrate to the United States aspire to improve theirmaterial standard of living, and (…) this generally entails a higher level of energy consumption and thus CO2 emissions.”
Acknowledging that there is no data that breaks down per capita CO2 emissions, the Center uses annual income as a surrogate for CO2 emissions. In other words, the higher the income of an individual, the larger their carbon footprint.
Not only are these generalizations simplistic but they open the door for an endless list of possible scenarios. By using the same logic, one could suggest that people shouldn’t strive to create a better life for themselves or achieve higher education because a higher standard of living is connected to higher income and thus a higher production of greenhouse gases.
Or even better, one could argue that if Americans really want to stop global warming they should be moving to Haiti, which has a per capita CO2 emissions rate of barely more than 1/100 that of the United States.
Climate change is a real problem that requires solution focusing on our energy choices and emissions policies. It is completely arbitrary to single out any group and suggest that by suppressing that group, we can solve climate change. Suggesting that we stop immigration altogether and encourage people to remain in poverty so they don’t increase their emissions is not a real solution. We need to solve our environmental problems in a comprehensive way, and we need too a workable, comprehensive solution for our broken immigration system

Arrests Made in Major Bank Fraud and Identity Theft Scheme
Richard K. Ruminski, Special Agent-in-Charge of the Milwaukee Office of the Federal Bureau of Investigation (FBI), announced today the arrests of MICHAEL B. VORCE, age 31 and JAMES C. JETT, age 29. The two suspects were arrested without incident by FBI special agents from the Milwaukee and Chicago Divisions on 8/27/08.
In a criminal complaint, the two suspects are charged with knowingly executing a scheme to defraud a financial institution, in violation of 18 United States Code Section 1344; and knowingly conspiring to defraud a financial institution in violation of 18 United States Code Section 371.
This multi-state bank fraud and identity theft scheme involves at least $2.6 million, and at least four financial institutions. The investigation is continuing as the individuals appear to be part of a larger fraud scheme. The bank fraud and identity theft committed involved the use of stolen personal information from victims and the use of the personal information to obtain high-dollar loans from financial institutions, purportedly to purchase boats. In some instances, the vessels themselves were fictitious.
Because of law enforcement’s focus on mortgage fraud, criminals may now be targeting alternative high-end items such as large boats to facilitate their fraud schemes.
The public is reminded that a criminal complaint is merely a method by which to charge individuals with criminal conduct. The defendants are presumed innocent until proven guilty

Robert M. MacLafferty, age 46, of Portland, Tennessee was sentenced January 29th to serve 5 months in prison, followed by 3 years of supervised release. His sentence also included the requirement to pay restitution to the IRS of $37 plus thousand.
According to the US Attorney’s news release:
MacLafferty pled guilty on October 12, 2007, to five counts of income tax evasion. During his plea hearing, MacLafferty admitted that he earned income which required him to file federal income tax returns for years 1996 through 2003, however, he failed to file such a return in each of those years. MacLafferty also admitted that he had adjusted gross income totaling $227,993 from 2000 to 2003. During this period of time, MacLafferty provided false documents to his employer claiming he was not a citizen of the United States and therefore not liable to pay federal income taxes. MacLafferty also admitted that after the Internal Revenue Service filed a federal tax lien against his residence in Sumner County, he quit claimed his interest in this property and another property to his wife.

Mr. Lin, a Fujianese man who was smuggled into the United States Undocumented, applied for and failed to obtain political asylum [and an order for his deportation was issued]. In 2006, he married Ms. Lu, an American citizen, and applied to change his immigration status. This past April, at Mr. Lin’s green card interview, the immigration judge suspected that their marriage was not real, although his wife was already eight-months pregnant. Mr. Lin was detained immediately and sent to the FBI.
Many lawyers not only criticized the immigration judge for violation of the couple’s human rights, but also warned that those who have outstanding deportation orders against them and who wanted to change status through marriage must be careful when applying for legal status.
On April 6th, Mr. Lin was deported by the Immigration and Customs Enforcement (ICE). When his wife received his phone call from the airport, she was in tears. Ms. Lu, who is due to give birth this week, said that ever since her husband was taken away in April, she has spoken to 10 different lawyers and has spent close to $10,000 hoping that her husband would be allowed to return to the United States. However, because the first lawyer they hired to assist through the green card interview handed Mr. Lin’s passport to the immigration judge during the interview, Mr. Lin had no documentation when he was deported.
Currently, Ms. Lu lives alone in a basement in Brooklyn. She worries since her family works in another state that no one can take care of her and her new born baby.
Nicolas Mundy, Ms. Lu’s current attorney, who does not agree with the immigration judge’s action, asked, “Why couldn’t the immigration agency wait 30 more days until the child is born, when they could conduct a DNA test and determine whether the marriage is real?”
According to Ms. Lu, right before she and her husband went to the green card interview, their first lawyer told them that Mr. Lin’s deportation appeal was pending. However, Mundy said that their appeal was denied in 2005, which meant that Mr. Lin’s deportation order became effective immediately after the interview. Moreover, when applicants for political asylum try to change their status through marriage, they should submit an affidavit to verify their marriage. Their first lawyer failed to do so.
John Chang, an experienced lawyer, explained that the USCIS has new policies that allow arriving aliens to obtain legal status by several means such as through marriage. Another lawyer said that according to experiences, for those who failed to obtain political asylum, trying to change statue through marriage could be risky.
Mundy said that Ms. Lu’s situation is very difficult, but not impossible. Ms. Lu can request a second time for her husband to be allowed to return after their child is born, if DNA evidence can establish his paternity. Mr. Lin would also need to go to the United States Embassy in China to apply for his return to the United States. Present USCIS regulations stipulate that once an alien is deported, he or she must wait 10 years before being allowed to return to the United States. Mr. Lin’s lawyer is hoping that by establishing that he is the father of a U.S. citizen who has faced inhumane treatment, it will make him a candidate for amnesty and the family can be reunited

LOS ANGELES MAN WHO MADE ‘DONATIONS’ TO JEWISH GROUP AND TOOK BOGUS TAX DEDUCTIONS AGREES TO PLEAD GUILTY.
A Los Angeles man who made “donations” to several charitable organizations associated with a New York-based orthodox Jewish group – “donations” that were largely refunded – has agreed to plead guilty to federal tax evasion charges.
In a plea agreement filed today in United States District Court in Los Angeles, Uri Mandelbaum, 70, of the Hancock Park district of Los Angeles, has agreed to plead guilty to two felony tax charges and to pay back taxes totaling more than $1.5 million.
The plea agreement with Mandelbaum is the first one involving a “donor” to charitable organizations associated with Spinka, which is at the center of a scheme alleged in a related criminal case. Spinka is a religious group within Orthodox Judaism based in Brooklyn, New York. The Grand Rabbi of Spinka, his assistant, several other defendants and five Spinka charities were indicted last year on a host of federal charges related to a wide-ranging conspiracy to defraud U.S. government agencies, to operate an underground money transfer system and to launder money through an Israeli bank (see: http://www.usdoj.gov/usao/cac/pressroom/pr2007/164.html). According to statements made during court during proceedings in that case, prosecutors have expanded their investigation, which now targets more than 100 individuals who were contributors to Spinka organizations.
In the plea agreement filed today, Mandelbaum admits that he evaded the payment of $296,731 in federal income taxes for the years 2005 and 2006, the two years that are the subject of the criminal charges. During 2005 and 2006, Mandelbaum made $892,483 in contributions to Spinka organizations, and then 95 percent of the contributions were returned to Mandelbaum. However, Mandelbaum admits that he claimed the entire $892,483 as charitable contributions on his federal income tax returns for the two years.
In the plea agreement, Mandelbaum also admits that he made contributions to Spinka-related entities from 2001 through 2004 that were reimbursed at a 95 percent rate. During those four years, Mandelbaum admits that hundreds of thousands of dollars went through the Spinka organizations, resulting in tax losses of $1,285,591.
Mandelbaum additionally admits that he received cash from Spinka organizations in order to give kickbacks to other contributors. During 2005 and 2006, Mandelbaum received $662,068 in cash that he relayed to others, according to his plea agreement.
Mandelbaum has agreed to appear in federal court in Los Angeles for an arraignment on July 28.
The statutory maximum penalty for the two counts of tax evasion is 10 years in federal prison and a $500,000 fine.
Two of the defendants charged in the main Spinka indictment have pleaded guilty (see: http://www.usdoj.gov/usao/cac/pressroom/pr2008/091.html). The other defendants are scheduled to go on trial before United States District Judge George P. Schiavelli on November 12.
