R. Alexander Acosta, United States Attorney for the Southern District of Florida, Jonathan I. Solomon, Special Agent in Charge, Federal Bureau of Investigation, Miami Field Office, Christopher B. Dennis, Special Agent in Charge, U.S. Department of Health and Human Services, Office of Inspector General, and Bill McCollum, Attorney General of the State of Florida, announced today that Miguel Almanza, formerly of Hialeah, FL, pled guilty in connection with a $56.7 million Medicare fraud scheme.

According to the government’s factual proffer, defendant Miguel Almanza operated and controlled thirteen durable medical equipment ("DME") companies, and three medical clinics located in Miami-Dade and Hillsborough Counties. Using these thirteen companies, Almanza and his co-conspirators submitted nearly $57 million of false claims to Medicare for medical equipment, prescription medications, and outpatient medical services.

Almanza and his partners concealed their control of these DME companies and medical clinics by recruiting "nominee" or "straw owners," who were typically paid a percentage of the fraud proceeds to sign the necessary corporate records and Medicare applications. Notably, Almanza often recruited family members from his hometown of Moron, Cuba, to serve as the nominee owners of his DME companies.

To execute the scheme, Almanza purchased the identities of various Medicare beneficiaries in Miami-Dade County, including their driver's licenses, Medicare cards, and other identification documents. Almanza would then use the patients' Medicare numbers to submit fraudulent claims to Medicare for a wide variety of high-priced medical equipment, including nebulizers, oxygen concentrators, powered air mattresses, and wheelchairs. During the early years of the conspiracy, Almanza and his partners paid monthly cash kickbacks to these "professional patients." The kickbacks were paid so that the patients would not report the false claims to Medicare. Over time, the scheme changed because Almanza and his partners found it cumbersome to pay kickbacks to dozens of patients. Consequently, Almanza and his partners began to purchase stolen patient identities from patient recruiters and billing companies.

Once Medicare paid the false claims, Almanza and his partners implemented complex schemes to launder the fraud proceeds and conceal their ultimate destination. In one version of the scheme, Almanza and his partners would distribute pre-signed corporate checks, often for amounts just under $10,000, to a broad network of so-called "check cashers." The "check cashers" would cash the checks at local banks throughout Miami-Dade County, often visiting numerous bank branches within one day so as to avoid raising red flags. The "check cashers" would keep a commission, typically about 10%, and give the remaining proceeds to Almanza and his co-conspirators.

Under a second laundering method, Almanza and his partners recruited nominee owners to open various sham corporations, including construction companies and investment firms. The Medicare fraud proceeds were deposited into the bank accounts of the sham corporations, and then later distributed to Almanza and his partners. Almanza used the fraud proceeds to purchase a home, luxury cars, and to finance other lavish personal expenditures. Almanza also used the funds for gambling at various South Florida casinos, where he often spent more than $10,000 per night.

Almanza faces a maximum term of ten years’ imprisonment for the Medicare conspiracy, and five years’ imprisonment for making false claims upon the United States .

Mr. Acosta commended the investigative efforts of the Federal Bureau of Investigation, the U.S. Department of Health and Human Services, Office of Inspector General, and the Office of the Attorney General of Florida, Medicaid Fraud Control Unit. Love has no Borders.

Same-sex couples walked joyfully down the aisle today for the first time in Connecticut, while gay activists planned to march in protests across the country over the vote that took away their right to marry in California.

Advocates said they expected thousands at a demonstration at Boston's City Hall Plaza later today, with gay couples and families featured to try to keep the tone positive, said Ryan McNeely, an organizer for the Join the Impact protest movement.

"We're not trying to convey an image of persecution, we're not trying to attack any specific group," he said. "The point we need to be making is that we need to bring everybody together and to respect each other, and that hate breeds hate."

Bubbles and white balloons bounced in the chilly autumn air as well-wishers cheered the marriage of Peg Oliveira and Jennifer Vickery in New Haven. They wed outside City Hall, next to a statue commemorating the struggle for freedom among captives on the Amistad slave ship.

Despite the roaring traffic and clicking cameras, "it was surprisingly quiet," Oliveira said after the brief ceremony. "Everything else dissolved, and it was just the two of us. It was so much more personal and powerful in us committing to one another, and so much less about the people around us."

The Connecticut Supreme Court ruled 4-3 on Oct. 10 that same-sex couples have the right to wed rather than accept a 2005 civil union law designed to give them the same rights as married couples. A lower-court judge entered a final order permitting same-sex marriage this morning.

"Today, Connecticut sends a message of hope and inspiration to lesbian and gay people throughout this country who simply want to be treated as equal citizens by their government," said the plaintiff's attorney, Bennett Klein.

There was no comparison between civil unions and marriage for Robin Levine-Ritterman and Barbara Levine-Ritterman, who obtained a civil union in 2005 and were among eight same-sex couples who sued for the right to marry.

"We didn't do it with pride or joy," Barbara Levine-Ritterman said of getting the civil-union license. "It felt gritty to be in a separate line."

Today, however, she proudly held up the first same-sex marriage license issued in New Haven as about 100 people applauded outside City Hall. She and her betrothed, who held red roses, plan to marry in May.

"It's thrilling today," Barbara Levine-Ritterman said. "We are all in one line for one form. Love is love, and the state recognizes it."

Manchester Town Clerk Joseph Camposeo, president of the Connecticut Town Clerks Association, said clerks in the state's 169 communities were advised by e-mail shortly after 9:30 a.m. that they could start issuing marriage licenses to gay couples.
"The feedback I'm getting from other clerks is that we're all at the ready, but no one really has a sense yet of what kind of volume we're going to get," he said.

According to the state public health department, 2,032 civil union licenses were issued in Connecticut between October 2005 and July 2008.

The health department had new marriage applications printed that reflect the change. Instead of putting one name under "bride" and the other under "groom," couples will see two boxes marked "bride/groom/spouse."

Massachusetts is the only other state allowing gay marriages. Like the highest courts in that state and Connecticut, the California Supreme Court ruled this spring that same-sex marriage is legal. After thousands of such unions were conducted in California, however, its voters last week approved Proposition 8, a referendum banning the practice.

Constitutional amendments to ban gay marriage also passed last week in Arizona and Florida, and Arkansas voters approved a measure banning unmarried couples from serving as adoptive or foster parents.

Gay rights advocates are citing Massachusetts as an example at planned rallies this weekend to demonstrate why gay marriage is beneficial to families and children.

"In Massachusetts, in particular, we have a great story to tell, a great story to tell about marriage equality, that it works and that it's good," said Marc Solomon, executive director of MassEquality.

Kris Mineau of the Massachusetts Family Institute, which opposes gay marriage, said planned and past protests, some of which have been angry in tone and targeted churches, are meant to intimidate the California high court into reversing its ruling that Proposition 8 was constitutional.

"We are a nation that goes by the rule of law," he said. "No court should ever be intimidated by mob rule. And that's what our opponents right now are trying to do."
The California vote has sparked protests and several lawsuits asking that state's Supreme Court to overturn the prohibition.

A group of Southern California activists have launched an effort to have simultaneous protests outside statehouses and city halls in every state Saturday. Demonstrations have been scheduled outside the U.S. Capitol and in more than 100 cities.

Activists also are aiming boycotts and protests at businesses and individuals who contributed to the campaign to pass Proposition 8. Many of the donors are members of the Church of Jesus Christ of Latter-day Saints, which played a significant role in encouraging its members to support the California ban.

Mormon churches in several states have become the focus of protests and some vandalism since the vote.

Since lawyers for gay rights groups and the cities of Los Angeles and San Francisco have asked the California Supreme Court to invalidate Proposition 8, same-sex couples in California are not flocking to Connecticut and Massachusetts to wed, said Shannon Minter, executive director of the National Center for Lesbian Rights.

"I think couples are still very hopeful they will be able to marry here," Minter said.
Connecticut voters could have opened the door to ending gay marriage last week by voting for a constitutional convention to amend the state's constitution, but the measure failed.

Peter Wolfgang, the executive director of the Family Institute of Connecticut, a gay-marriage opponent, acknowledged that banning gay weddings in Connecticut will be difficult but vowed not to give up. He condemned the high court's decision as undemocratic.

"Unlike California, we did not have a remedy," Wolfgang said. "It must be overturned with patience, determination and fortitude."
The state's 2005 civil union law will remain on the books for now. Same-sex couples can continue to enter civil unions, which give them the same legal rights and privileges in Connecticut as married couples without the status of being married. Several states, including California, allow domestic partnerships or civil unions for same-sex couples.

The 2000 census reported that 594,000 households in the United States were headed by same-sex partners, a figured considered by some experts to be conservative. Of those, about 33 percent of lesbian couples reported having children 18 years old or under, while 22 percent of male couples did.
Another studies show that children of gay and lesbian parents are developmentally similar to those with heterosexual parents, said Charlotte J. Patterson, a professor of psychology at the University of Virginia who has studied gay and lesbian families. In general, Professor Patterson noted, parenthood for gay and lesbian couples is a conscious choice, but there are as yet no adequate studies measuring stress levels in their children.

There are no reliable comparisons to the 1990 census, but ''it's very clear that gay fatherhood has risen significantly over the past 8 years.
But while Proposition 8, Amendment 2, Proposition 102 and Arkansas’ ban on gay adoption gathered most of the LGBT political attention this week, there’s certainly some good news coming out of the U.S. House of Representatives. Some of the most anti-gay politicians in our country were ousted, ushering in new leadership that stands to not only benefit the gay rights movement, but civil rights as a whole. Below is a list of the top ten anti-gay Congress members sent packing after this Election.

Rep. Marilyn Musgrave

Musgrave made her name in 2002 by championing a federal constitutional amendment banning gay marriage. That’s a move so conservative, Republican Presidential candidate John McCain and Vice President Dick Cheney wouldn’t even support it. But that still didn’t stop Musgrave from labeling gay marriage “the most important issue that we face toady,” and that the “future is grim” if gay marriage is not banned. With priorities like those, despite such urgent issues as the tanking economy, two wars, and a broken health care system, it’s no wonder Musgrave was sent home this Election year.

Rep. Virgil Goode

This race still isn’t officially over, but all signs are pointing to an upset here as attorney Tom Perriello seems to have pulled off the unthinkable – toppling 10-year Virginia incumbent Virgil Goode. Despite the fact that Goode actually funneled federal money to filmmakers who produced gay films, Rep. Goode himself was a virulent opponent of gay rights, championing the Marriage Amendment Act to ban gay marriage, and alleging that Barack Obama was dangerously supportive of gay rights. Goode has also made derogatory comments about Muslims, and has called opponents of the Iraq War Jihadists.


Rep. Steve Chabot

Chabot is the proud owner of a 0% rating from the Human Rights Campaign, and it’s no wonder why. Chabot voted for a constitutional amendment banning gay marriage, voted to ban gay adoptions in the District of Columbia, and voted no on the Employment Non-Discrimination Act. Of all of those issues, it is Chabot’s work to ban gay marriage that makes his record on gay rights most repulsive. In 2004, Chabot chaired the House Judiciary Committee’s Sub-Committee on the Constitution, which held at least five days worth of hearings about the need to ban gay marriage. With Chabot being sent back to Ohio, it’s good to know that his hands won’t be rewriting anyone’s Constitution in the near future.


Rep. Robin Hayes

He was almost ousted in 2006, but in 2008 North Carolina voters finally sent Robin Hayes packing. Hayes became famous for putting his foot in his mouth, when he accused liberals of hating Americans and hating God. But Hayes was equally as offensive when it came to gay rights, telling public rallies that gay marriage undermines healthy families. It’s no surprise that he supported a Constitutional amendment to ban gay marriage, that he voted to ban gay adoptions, and that he voted against anti-discrimination efforts aimed at addressing prejudice in hiring toward LGBT persons.

Rep. Jon Porter

Nevada voters sent a loud and clear message to Jon Porter that a 0% rating from the Human Rights Campaign isn’t something to brag about. Porter, like many of the others on this list, voted yes on a Constitutional Amendment banning gay marriage, and voted to block implementation of the Employment Non-Discrimination Act.

Rep. Tim Walberg

Walberg was elected in 2006 in large part because he championed conservative positions on social issues like abortion and gay marriage. It’s nice to see that Michigan voters rejected this same schtick the second time around. Walberg was vehemently against gay marriage, gay adoption, and expansion of anti-discrimination efforts addressing sexual orientation. Walberg even went so far as to say that “It’s a sin to be gay.” Looks like Michigan voters are a little more tolerant than Walberg.

Rep. Randy Kuhl

Kuhl has been voting against gay rights legislation dating back to 1993, and his position hasn’t changed over time. Kuhl consistently received a 0% rating from the Human Rights Campaign, and once said that he “doesn’t support” the homosexual lifestyle. So while Kuhl was once labeled “one of the best golfers” in the U.S. Congress, his record on gay rights was quite dismal. Looks like he’ll have more time to practice his golf game now that New York voters refused to reward him with another term in Congress.

Rep. Bill Sali

It’s hard to single-out Sali on gay rights issues, as the man was crazy on a number of fronts. When Sali was a member of the Idaho House of Representatives, his offensive comments about breast cancer caused a fellow representative (and survivor of breast cancer) to walk out of the chambers in tears. And he was once labeled my members of his own party as being a person without “one ounce of empathy in his whole fricking body.” But Sali’s record on gay rights was abysmal. He once voted against a domestic violence bill because he thought its passage would lead to same-sex marriage. He’s also on record as wanting to reinstitute sodomy laws. Yikes.

Rep. Ric Keller

Despite the passage of Amendment 2 in Florida voters sent packing Congressman Ric Keller, another person on this list with a whopping 0% rating from the Human Rights Campaign. In addition to being against gay marriage and gay adoption, Keller was against the Employment Non-Discrimination Act. Sound familiar?



Rep. Tom Feeney

Sticking with Florida, the neighboring Congressional district to Ric Keller also sent an anti-gay politician home – Tom Feeney. In the wake of California’s Supreme Court ruling in May 2008 legalizing same-sex marriage, Feeney actually issued a press release chastising “San Francisco values.” Maybe if Feeney spent more time worrying about Florida instead of San Francisco, he’d still be in Congress today

Sen. Joe Biden, the Senate Foreign Relations Committee's incoming chairman, and running know for Vice President wants to get tough with Mexico, calling it an "erstwhile democracy" with a "corrupt system" responsible for illegal immigration and drug problems in the U.S.

Biden, D-Del., was in Columbia months ago in his first post election trip to this first-in-the-South presidential primary state.
During a question-and-answer session before more than 230 Columbia Rotary Club members, Biden was asked about immigration problems.

Biden, who favors tightening the U.S.-Mexico border with fences, said immigration is driven by money in low-wage Mexico. On my opinion I will said driven by the unscrupulous NAFTA trade agreement who put Millions of Mexicans away from their Jobs, Their Lands, Their Families and their Country.

"Mexico is a country that is an erstwhile democracy where they have the greatest disparity of wealth," Biden said. "It is one of the wealthiest countries in the hemisphere and because of a corrupt system that exists in Mexico, there is the 1 percent of the population at the top, a very small middle class and the rest is abject poverty."

Unless the political dynamics change in Mexico and U.S. employers who hire illegal immigrants are punished, illegal immigration won't stop. "All the rest is window dressing," he said.

An even bigger problem are illegal drugs "coming up through corrupt Mexico," he said. "People are driving across that border with tons, tons — hear me — tons of everything from byproducts for methamphetamine, to cocaine, to heroine." I hear you clearly and loud Mr. Biden but seems to me like you listen to the dubious and Anti Immigrant Lou Dobbs at CNN where there is no other point of Entry of Drugs, of people; Shame on you Mr. Biden....There had been found many indoors marijuana plants farms within the States, many Labs producing methamphetamine and other drugs and for that source I shouldn't use Lou Dobbbs either CNN. Covering a variety of topics, Biden kept most of the crowd in their seats for an hour — twice as long as scheduled.
"I warn all of you, all of you making more than a million bucks — I hope you all are — I'm taking away your tax cut," Biden said. "I'm not joking."
Sounds like Barack Obama will need to have a debate with Joe Biden, in addition to John McCain.

Undocumented Immigrants Stealing Social Security Benefits?

That's sounds familiar to you. Well check this out. Buchanan County Auditor Susan Montee’s failure to audit the county administrator under investigation for embezzling $4 million in Social Security payments raises serious questions about whether Montee intentionally ignored the situation because of her political and personal relationship with the administrator.

The Associated Press reports that state investigators are questioning Bonnie
Sue Lawson in connection with the missing Social Security checks dating back to at least 2005 when complaints were first made to the state Department of Health and Senior Services. Montee, who has the authority to conduct an audit of the state administrator’s office, has received hundreds of dollars in political contributions from friend Lawson.

“The political and personal relationship between Susan Montee and Bonnie Sue Lawson raises serious questions about how millions of dollars in essential payments to elderly Buchanan County residents disappeared right under Montee’s nose,” said Paul Sloca, communications director for the Missouri Republican Party. “Susan Montee must come clean about her relationship with Bonnie Sue Lawson and the role it played in her failure as county auditor. This situation also raises serious issues about Montee’s competency and integrity as a candidate for state auditor.”

State investigators and St. Joseph police have seized computer equipment and other documents from Lawson’s office in a case that potentially affects hundreds of clients. Montee’s failure to monitor the activities of the county administrator is serious since administrators often serve as guardians, conservators, personal representatives and representative payees for certain citizens including minors, the mentally incompetent and the disabled.

“Susan Montee failed to keep an eye on an individual who is entrusted with the responsibility of taking care of the finances for some of our state’s most vulnerable citizens,” Sloca said. “One has to wonder whether her personal and political relationship was more important to her than the citizens of Buchanan County.
Know John F. Wood, United States Attorney for the Western District of Missouri, announced that a former Buchanan County, Mo., official pleaded guilty in federal court today to embezzling $118,000 from Social Security payments intended for dependent or disabled clients served by her office.
Bonnie Sue Lawson, 68, of St. Joseph, Mo., waived her right to a grand jury and pleaded guilty before U.S. District Judge Gary A. Fenner this afternoon to a federal information that charges her with stealing public money.
“This former elected official abused the public’s trust and stole public money that was intended to assist the vulnerable clients who were dependent upon her,” Wood said.
Lawson served as Buchanan County Public Administrator from her election in 1996 until her resignation in August 2006. As Public Administrator, Lawson was appointed as the guardian for mentally impaired or developmentally disabled adults in instances where these adults had no one else who was willing to act on their behalf. Some of the clients under Lawson’s care received Social Security Administration benefits on a monthly basis. Lawson, who was appointed by the Social Security Administration as the representative payee for clients who were identified as either physically or mentally unable to handle their own financial affairs, established separate bank accounts where the Social Security funds were deposited. Lawson maintained control over the accounts.
By pleading guilty today, Lawson admitted that, from Sept. 1, 2003, to Aug. 21, 2006, she embezzled funds from these accounts for her own use.
Lawson accomplished her embezzlement by generating checks payable to herself under the guise that the proceeds were to pay her fees. The checks or embezzled monies were above and beyond any legitimate payments due to Lawson as representative payee. Lawson then altered the accounting records, maintained electronically, in her Public Administrator’s office in order to conceal her embezzlement. Lawson also concealed her embezzlement by submitting false and fraudulent reports to the Social Security Administration.
Approximately 120 separate client accounts were identified by investigators as having been embezzled by Lawson. Investigators also calculated an aggregate loss figure of approximately $118,000 from Lawson’s embezzlement activities. This sum represents Social Security payments intended for the use and care of dependant or disabled clients.
Under federal statutes, Lawson is subject to a sentence of up to 10 years in federal prison without parole, plus a fine up to $250,000 and an order of restitution. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.

Why so much hate against Undocumented Immigrants?

The Native Americans are not happy with the Goverment, the religious community is unhappy too, and we’ve earned a visit from the Human and Civil Rights Commission. How absolutely humiliating is for us as Americans.

And the Anti-immigration sentiment continue as a manifestation of fear, and only appears when American economic interests are unstable; when economic interests are secure, bringing in Undocumented Immigrants to work under conditions that citizens reject is considered beneficial to capitalism, just as slavery was 500 years ago. They so called Patriots, Nativist and Protectionist Americans descended from the original INVADERS, who thought it proper to slaughter the natives objecting to the disruption and thievery visited upon them by the "settlers.

Since the beginning of this unjust war against an innocent people who we now know had nothing to do with the events on 9/11. I feel betrayed by my own government. The government has lied to us repeatedly and continues to instill fear and hatred into our hearts. It has used this event to turn against our neighbors from Mexico who seek to live a better life. Fear has been carefully and manipulatively manufactured against undocumented workers and families. And we used 9/11 to turn them into enemies and Terrorists against of our nation when they are not enemies at all.

Homeland Security has become misguided in its mission to protect this country from terrorists. Instead it sees all immigrants as a sort of terrorist and encourages the citizens of this country to do the same. Hatred and xenophobia are at an all time high in this country of bountiful.

It was not so long ago, that America saw the horrors of one such dictator who marched across Europe, rounding up 11 million Jews, gays, and political opponents sending them to concentration camps to be gassed or tortured to death. The argument used: it was a war between Christianity and Judaism. We were in denial that this could happen. We are in denial that it is still happening in parts of our world today. Yet, this dictator used language of faith for his arguments and the religious people gave ascent because they were also fearful. Fear is a powerful tool for submission of the masses. Fear if not checked will crush a person’s or a nation’s spirit just like a dog who has been abused who comes whimpering at the call of its owner.

I pray for America’s repentance in its arrogance in thinking it is the world’s savior. I wants America’s people that will let go of paralyzing fear and embrace love and compassion for other nation’s people. I want America once again capture the vision of its integrity and dignity and respond from this core and not from deceit and shear military power. I hope that America will begin to understand that with great gifts and riches are also given great responsibility and accountability to the world community. That this abundance is to be shared not hoarded. Not doled out as charity where the poorer nations grow reliant on it or beholden to do our biddings, but shared in a manner that enables self-empowerment and development of emerging equal partners in the global community. I pray that America will turn from its domestic sins of racism, xenophobia, and corporate greed to enable all of its citizens; its people, its wildlife, its vegetation to thrive within its borders.

You tell me, is there any other avenue for LEGAL immigration. If one opposes all avenues for legal immigration, how can one be not an anti-immigrant? So how Lou Dobbs, Tommy Tancredo, Dan Stein, William Gheen, and the most Anti's they saying the are Pro Legal Immigration? Lies, Lies, Lies.

However, there are two points that American citizens have to acknowledge in good faith:

1.-Unskilled workers must enter legally and be on line? There is no line and not legal pathway to become legally as an unskilled workers. That is a lie and whoever upholds it is doing a disservice to the discourse on immigration and igniting the flames of hostility.
People who come here Undocumented have to save up for years to afford the passage, risk their lives on the border, risk their families, and then risk deportation once they get here. Do you think they would do that if there were a legal path for them?

2.-There are millions of Undocumented immigrants in this country already who have working for years and have become productive members of society. By some estimates there are about 12 million, perhaps probably less but the question is. Where that number coming from? Who counted every single Undocumented Immigrant? Are there 12, 20 30 Millions Undocumented Workers in U.S. as the Anti Immigrants and Lou Dobs claimed? Probably not. About 3/4 are working adults, thus, assuming the right-wingers had their way and they were deported, who would feel the vacuum? Are there 8 million UNSKILLED unemployed Americans? Look at the unemployment rate: this nation has one of the highest unemployment rates in the developed world. In fact, despite recent remorse in the economy, it is lower than it was during parts of the 90s.

In short, my fellow Americans, let's have a discussion that is grounded in reality. The decision the American people makes in the end will be the best ONLY if the facts are acknowledge. I cannot emphasize enough how erroneous the idea of Undocumented immigrants breaking the law because it is easier and they want to become unlawful and fugitive of the Laws. In our colloquial vernacular: THERE AIN'T NO LINE OR OTHER WAY FOR THEM TO LEGALIZE THEIR STATUS.
